1. Acceptance of Terms

By accessing or using VoxAIAgent.com ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. You affirm that you are of legal age to enter into this agreement.

2. Description of Service & AI Disclosure

VoxAIAgent.com provides AI-powered receptionist and outbound calling services. You acknowledge and agree that:

• The Service utilizes artificial intelligence to generate voice responses.
• The Service is not a replacement for emergency services. You may not use the Service to call 911 or other emergency lines.
• The AI may occasionally generate incorrect or "hallucinated" information. You are responsible for verifying the accuracy of critical information handled by the Service.

3. Legal Compliance & Call Recording

IMPORTANT: You are solely responsible for compliance with all applicable laws.

• Call Recording Laws: Many jurisdictions require the consent of one or all parties to record a phone call. You agree to comply with all applicable recording laws. You are responsible for configuring your AI agent to announce that calls are recorded if required by your local laws.
• TCPA & Telemarketing (Outbound): For outbound campaigns, you explicitly represent and warrant that you have obtained "prior express written consent" from all recipients as required by the Telephone Consumer Protection Act (TCPA) and other anti-spam laws. You generally cannot use this Service to cold-call consumers with automated voice messages without their prior permission.
• Do Not Call (DNC) Registry: You are responsible for scrubbing your contact lists against the National Do Not Call Registry and your internal DNC lists before using the Service.

4. Acceptable Use & Right to Refuse Service

VoxAIAgent.com is intended for legitimate, legal business use only. We maintain a zero-tolerance policy for the misuse of our AI technology.

• No Manipulation: You may not attempt to manipulate, "jailbreak," or trick the AI into saying anything inappropriate, illegal, offensive, or outside the scope of legitimate business conversation.
• Prohibited Content: You are strictly forbidden from using the Service to generate hate speech, harassment, sexual content, or instructions for illegal acts.
• Right to Refuse: We reserve the right to refuse service to any individual or business, or to cancel any subscription, if we believe the Service is being used for illegitimate or harmful purposes.
• Immediate Banning: Any user found attempting to bypass AI safety guards or using the Service for fraudulent or illegal purposes will be permanently banned from the platform without refund.

5. Prohibited Uses

You agree not to use the Service for:

• Emergency calls or critical safety communications.
• Debt collection, gambling, or adult content services.
• Harassment, threats, or hate speech.
• Fraudulent activity, impersonation, or phishing.
• Any activity that violates the rights of others or applicable laws.

6. Indemnification

You agree to indemnify, defend, and hold harmless VoxAIAgent.com, its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

• Your access to or use of the Service.
• Your violation of these Terms or applicable laws (specifically including TCPA and recording consent laws).
• Your content or the contact data you provide.

7. Payment and Subscription

Services are billed on a subscription basis. We use Stripe for payment processing. Unused credits generally expire at the end of your billing cycle unless otherwise stated in your plan. We reserve the right to change our pricing upon reasonable notice.

8. Data Retention

We may retain call logs, recordings, and transcripts for a limited period to provide the Service. You are responsible for exporting any data you wish to keep long-term. We may delete data associated with inactive or terminated accounts.

9. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Accounts found violating TCPA or anti-spam regulations will be terminated immediately without refund.
